Spencer & Mulally
A Collaborative Approach To Your Case

Recovering Your Assets Through Quick Action

In business, time is not always a luxury. At Spencer & Mulally, our attorneys understand that companies need to act and resolve disputes quickly. Seeking prejudgment remedies allows our clients to immediately begin the process of recovering their assets. We are headquartered in Sherman Oaks, California, and serve local and out-of-state clients.

Writs Of Attachment

Writs of attachment can be used to seize the assets of your debtor in commercial collection cases. In the application for the writ, we explain to the court why you are more likely than not to prevail in the eventual litigation. Once this is established, a sheriff is sent to procure those assets from the debtor. At this point, you can retrieve your assets by putting up a bond. We will assist you in obtaining the necessary bond.

Our lawyers are experienced and knowledgeable in dealing with the numerous complex forms. Over the years, we have completed more than 5,000 writs of attachment. We are familiar with meeting the court's requirements. On the occasion a court is not willing to grant a writ of attachment, we can still go after your assets by means of a temporary restraining order. This process can be done quickly in an ex-parte or emergency situation.

Writs Of Possession

If a debtor in a secured transaction or an equipment lease refuses to pay, a writ of possession can be used to recover your property. At Spencer & Mulally, we can obtain a writ of possession by going to court and requesting that your equipment or collateral be seized. Once seized by the sheriff, the items will be held pending judgment. We are extremely experienced enacting the formalities involved and can quickly acquire a writ of possession. Writs can be obtained on an emergency basis.
